Terms of Service

These Terms of Service ("Terms") govern your access to and use of Product Creator, including our website, software, applications, features, digital-product creation tools, AI-assisted features, and related services (collectively, the "Service").

The Service is operated by Affiliate Profit Pages, doing business as Product Creator ("Product Creator," "we," "us," or "our").

By creating an account, purchasing a plan, or otherwise accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility and accounts

You must be legally capable of entering into a binding agreement in your jurisdiction to use the Service.

You are responsible for providing accurate account information, maintaining the confidentiality of your login credentials, and all activity occurring through your account. You must promptly notify us if you believe your account has been accessed without authorization.

You may not share, sell, transfer, or provide unauthorized access to your account except where a Product Creator plan or feature expressly permits additional users.

2. What Product Creator does

Product Creator is a software tool designed to help users plan, generate, organize, design, and export materials associated with digital products.

Depending on the features and plan available at the time, the Service may assist with materials such as product concepts, written content, product blueprints, PDFs, cover or hero imagery, sales-page content, delivery-page content, opt-in materials, marketing copy, and other digital-product assets.

Some features may use artificial intelligence supplied by Product Creator or third-party AI providers.

Product Creator is a creation tool. Unless we expressly state otherwise for a specific feature, we do not host, sell, market, publish, distribute, process payments for, or operate the digital products you create. You are responsible for publishing, hosting, selling, and delivering your products using the platforms and services you choose.

3. AI-generated and AI-assisted content

AI can produce inaccurate, incomplete, inconsistent, offensive, duplicated, or unsuitable material. It can also misunderstand instructions or generate material that resembles existing content.

AI output is not guaranteed to be factual, unique, original, legally compliant, commercially successful, or fit for any particular purpose.

You are responsible for reviewing, editing, fact-checking, and approving all generated material before publishing, selling, distributing, or relying on it.

You must independently verify important facts, claims, citations, statistics, legal statements, financial statements, health statements, and other information where accuracy matters.

Product Creator does not provide legal, tax, accounting, investment, medical, or other regulated professional advice.

4. Your products and business decisions

You remain responsible for the products and businesses you create using the Service.

Product Creator does not guarantee that a product idea is viable, that customers will buy it, that marketing will generate traffic or sales, or that use of the Service will result in income, profit, leads, customers, rankings, engagement, or any other business result.

You are responsible for determining appropriate pricing, claims, disclosures, refund policies, taxes, licensing requirements, consumer-protection obligations, and other requirements applicable to your business and customers.

5. Your content

"User Content" means information, instructions, prompts, text, files, logos, images, brand materials, URLs, product information, and other materials you submit to the Service.

You retain your rights in your User Content.

You grant us a limited, non-exclusive right to host, process, reproduce, transmit, and otherwise use your User Content only as reasonably necessary to operate, secure, maintain, improve, and provide the Service, subject to our Privacy Policy and applicable law.

You represent that you have the rights and permissions necessary to submit your User Content and use it with the Service.

AI-assisted features are intended to process product and content information, not personal data about you or third parties. You must not include personal information about yourself or any other individual — such as full names, contact details, or other identifying information — in a product idea, prompt, or other AI-processed field, except information you are authorized to submit about your own business.

You may choose to include personal information about yourself or others in your product content — for example, an author photo, headshot, name, or biography on a product cover. You are solely responsible for that decision and for having any rights or consents necessary to include it. You provide such information at your own risk, and Product Creator is not responsible for how that content is used, displayed, or distributed once you publish, export, or share your product.

6. Output and ownership

As between you and Product Creator, and to the extent permitted by applicable law and subject to third-party rights and provider terms, we do not claim ownership of the final content generated specifically for you through your use of the Service.

Laws concerning ownership and copyright protection of AI-generated material continue to develop and differ between jurisdictions. We do not guarantee that any AI-generated output is copyrightable, exclusive, or free from third-party rights.

You are responsible for reviewing output before commercial use.

7. Acceptable use

You may not use the Service to:

• violate applicable law or another person's rights;
• infringe copyrights, trademarks, privacy rights, publicity rights, or other intellectual-property rights;
• create, distribute, or facilitate unlawful, fraudulent, deceptive, defamatory, or malicious content;
• impersonate another person or falsely represent an affiliation;
• upload malware or attempt to compromise the Service;
• bypass security, access controls, usage limits, or billing controls;
• scrape, reverse engineer, probe, attack, overload, or disrupt the Service except where applicable law expressly permits otherwise;
• use another person's credentials without authorization;
• resell access to the Service unless your plan expressly permits resale or white-label use; or
• use the Service in a manner prohibited by an applicable third-party provider whose technology is used to deliver a feature.

We may restrict or suspend access where reasonably necessary to protect the Service, users, third parties, or comply with law.

8. Third-party services

Product Creator may integrate with or generate materials intended for third-party platforms, including website builders, funnel platforms, AI providers, payment processors, email services, storage providers, or other services.

Those services are independent from Product Creator and may have their own terms, privacy policies, fees, restrictions, APIs, and technical limitations.

We do not control third-party services and are not responsible for their availability, changes, outages, policies, pricing, data handling, or decisions to limit or terminate access.

The availability of a Product Creator feature that relies on a third party may change if that third party changes or discontinues its service or API.

9. Subscriptions, credits, and payments

Certain features require a paid subscription, usage credits, one-time purchase, or other paid plan.

Current prices, usage allowances, billing intervals, and included features will be displayed at purchase.

Unless otherwise stated at checkout, recurring subscriptions automatically renew at the applicable billing interval until cancelled.

You authorize the applicable payment processor to charge the payment method associated with your account for amounts due.

Usage allowances or generation credits may be subject to limits, expiration rules, fair-use restrictions, or plan-specific conditions disclosed when purchased.

We may change future pricing or plan features. Changes affecting an existing recurring subscription will be communicated as required by applicable law.

10. Cancellation

You may cancel a recurring subscription through the cancellation method provided by Product Creator or by contacting us at info@affiliateprofitpages.com.

Unless applicable law requires otherwise, cancellation stops future renewals and does not automatically refund charges already paid. You may retain access until the end of the paid billing period unless otherwise stated.

11. Refunds

Refund eligibility is governed by the Product Creator Refund Policy presented at purchase and available on our website.

Nothing in these Terms limits refund, cancellation, or consumer rights that cannot legally be waived.

12. Beta and experimental features

We may make beta, preview, experimental, or early-access features available.

Such features may be incomplete, change without notice, contain errors, or be discontinued. You should not rely on experimental features for critical business operations unless we expressly state otherwise.

13. Availability and changes

We work to maintain a reliable Service but do not promise uninterrupted or error-free availability.

We may modify, improve, replace, add, or discontinue features as the Service develops. Where a material change affects a paid service, we will provide notice where required by law.

14. Intellectual property

The Product Creator software, interface, branding, logos, website design, proprietary templates, underlying technology, documentation, and other materials supplied by us are owned by or licensed to Product Creator and are protected by applicable intellectual-property laws.

Except for rights expressly provided under your plan, these Terms do not grant you ownership of Product Creator itself or permission to copy, redistribute, reverse engineer, sublicense, or create competing copies of our proprietary software or protected materials.

15. White-label and reseller rights

If Product Creator offers a white-label, reseller, agency, or commercial licensing plan, your rights are limited to the specific license terms presented with that plan.

Purchasing a standard Product Creator subscription does not automatically give you the right to resell, sublicense, duplicate, white-label, or redistribute the Product Creator software.

Separate white-label or reseller terms may supplement these Terms.

16. Disclaimers

To the maximum extent permitted by law, the Service is provided "as is" and "as available."

We disclaim warranties that the Service will be uninterrupted, error-free, completely secure, or that generated output will be accurate, unique, complete, legally compliant, or suitable for your particular purpose.

Nothing in these Terms excludes warranties or rights that cannot legally be excluded.

17. Limitation of liability

To the maximum extent permitted by applicable law, Product Creator and Affiliate Profit Pages, including their owners, officers, employees, contractors, and affiliates, will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, business opportunities, goodwill, or anticipated savings arising from or related to the Service.

To the maximum extent permitted by law, our aggregate liability arising from or relating to the Service will not exceed the amount you paid to Product Creator for the Service during the 12 months immediately preceding the event giving rise to the claim.

These limitations do not apply where applicable law prohibits them.

18. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless Product Creator and Affiliate Profit Pages from third-party claims, damages, liabilities, and reasonable costs arising from your unlawful use of the Service, your User Content, products you publish or sell, or your infringement of another person's rights.

19. Termination

You may stop using the Service at any time.

We may suspend or terminate access if you materially breach these Terms, fail to pay amounts due, create a security risk, misuse the Service, or where suspension or termination is reasonably necessary to comply with law.

Where reasonable and legally permitted, we will provide notice and an opportunity to remedy a breach before permanent termination.

20. Governing law

These Terms are governed by the laws of the Province of British Columbia and the applicable federal laws of Canada, without regard to conflict-of-law principles.

Subject to any mandatory consumer rights or jurisdictional rules that apply to you, disputes relating to these Terms or the Service will be brought before the courts located in British Columbia, Canada.

21. Changes to these Terms

We may update these Terms as Product Creator develops or legal requirements change. We will update the "Last Updated" date and provide additional notice where required by law.

Your continued use after an update takes effect constitutes acceptance to the extent permitted by applicable law.
